Who is Responsible for Electrical Safety?
Who is Responsible for Electrical Safety?
Many landlords and business owners assume electrical equipment is safe as long as it’s working.
In reality, responsibility for electrical safety goes further than that — and it’s often misunderstood.
Why Electrical Safety Is Often Overlooked
Something I’ve noticed speaking to landlords and small business owners is that most don’t naturally think of themselves as being responsible for electrical safety.
Equipment is bought, it works, and nothing appears wrong — so it’s assumed to be fine. On the surface, that feels reasonable. The issue is that electrical safety doesn’t really work like that.
Faults don’t always show themselves. Cables, plugs and internal components can deteriorate over time while the appliance continues to work as normal.
Who Is Actually Responsible?
Responsibility isn’t based on how something looks — it comes from providing that equipment for others to use.
Whether that’s a tenant, a member of staff or a customer, there is a duty to ensure that equipment is maintained in a safe condition.
This is reflected in the Electricity at Work Regulations 1989, which place responsibility on those in control of electrical equipment in a work or rental environment.
What Happens if Something Goes Wrong?
If an electrical fault leads to an incident, the first question is usually whether the equipment has been properly maintained.
That includes:
- Whether checks have been carried out
- Whether issues have been identified and addressed
- Whether there is a record of that maintenance
Without that, it can quickly become an insurance and liability issue — regardless of whether the equipment appeared to be working at the time.
How PAT Testing Helps
PAT testing provides a structured way of checking electrical equipment, identifying faults early, and keeping a clear record of maintenance.
It’s not about overcomplicating things — it’s simply about making sure equipment is properly checked and that responsibility is being managed in a clear, consistent way.
Thorn PAT Testing provides PAT testing services for landlords and businesses across Glasgow, Bearsden, Milngavie and surrounding areas.
